Privacy Policy

Whizdotai, Inc., its affiliates and subsidiaries (“Whiz.ai” “we” or “us” or “our“), located at Suite 105, 220 Davidson Ave, Somerset, NJ, 08873, USA, is committed to protecting your privacy and developing technology that gives you a powerful and safe online experience. This Privacy Policy (the “Policy”) applies to the personal information we obtain through our properties, including websites, mobile applications and social media pages; offline collection in connection with sales, marketing, partner and supplier engagement; and third-party sources, including ad networks and lead brokers (the “Platform”).

By using the Platform, you consent to the data practices described in this Policy. All capitalized words not defined herein shall have the meanings ascribed to them in the Terms of Use.

Personal Information We Collect

Personally identifiable information or “personal information” is data that can be used to identify or contact a single person. You may provide us with personal information that may include, but not be limited to, your e-mail address, name, home or work address, telephone number, name of the company or business your work for, location data (such as data derived from your IP address, country and zip code) and the precise geolocation of your mobile device where we have provided notice and choice, as appropriate.

As is true of most applications and websites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. 

Cookies and Similar Technologies

Like most companies, we use cookies and similar technologies (“cookies”) on our websites to personalize and enhance your experience on our Platform.  To collect this information, when you use the Platform, a “cookie” may be set on your device or computer. Cookies contain a small amount of information that allows our web servers to recognize you whenever you visit. We store information that we collect through cookies, log files and/or clear gifs to create a “profile” of your preferences. We do not tie your personal information to information in the profile. We use this information that we collect, which does not identify individual users, to analyze trends, to administer the Platform and/or our website and to gather demographic information about our user base as a whole. We do not provide this information to outside parties other than set forth in this Policy. No personal information is stored in cookies and we do not link collected data to personal information.

How We Use Your Personal Information

The Platform uses your personal information to personalize and enhance your experience on our Platform.  We may use the personal information we obtain to: (i) communicate about and administer our products, services, events, programs and promotions (such as by sending alerts, promotional materials, newsletters and other marketing communications); (ii) conduct and facilitate surveys, focus groups and market research initiatives; (iii) perform data analytics (such as market research, trend analysis, financial analysis and customer segmentation); (iv) engage in ad retargeting and evaluate the effectiveness of our marketing efforts (including through our participation in ad networks); and (v) conduct marketing and sales activities (including generating leads, pursuing marketing prospects, performing market research, determining and managing the effectiveness of our advertising and marketing campaigns and managing our brand).

 We may combine personal information we obtain through the Platform with information we obtain through other channels for the purposes described above. We may anonymize or aggregate personal information and use it for the purposes described above and for other purposes to the extent permitted by applicable law. We also may use personal information for additional purposes that we identify at the time of collection. We will obtain your consent for these additional uses to the extent required by applicable law.

Except as set forth in this Policy, we will not use, disclose, or transfer your personal information or the personal information of others you have provided us unless (1) you expressly authorize us to do so; (2) it is necessary to allow our service providers or agents to provide services for us, (3) it is necessary in order to provide our products or services to you (and contacting you when necessary), (4) subject to applicable contractual or legal restrictions, it is disclosed to entities that perform marketing services on our behalf or to other entities with whom we have joint marketing agreements, (5) it is necessary to protect the confidentiality or security of your records, (6) it is necessary in connection with other business purposes including, without limitation, customer care, service quality, business management and operation, risk assessment, security, fraud and crime prevention/detection, monitoring, research and analysis, marketing, customer purchasing preferences and trends and dispute resolution, (7) it is necessary to comply with law enforcement, governmental mandate, or other legal requirement, if appropriate, for your protection or in connection with an investigation or prosecution of possible unlawful activity; (8) it is necessary for us to provide it to our attorneys, accountants, regulators, auditors or other advisors; or (8) it is otherwise necessary for us to disclose it as required or permitted by law. We reserve the right to transfer to relevant third-parties any information we have about you in the event of a potential or actual sale or transfer of all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation) or other business combination. In such case, we will require the relevant third parties to provide comparable levels of protection as we provide with respect to the information we share.

We may use Platform and/or web site analytics tools and technologies regarding activities on the Platform and/or web sites that require storage of session data. The overall aim of this is to aid in making our Platform easy to use and to proactively identify and correct error conditions. These tools and technologies may also be used to assist users who report problems in the use of the Platform. Stored session data is used in accordance with this Policy.

From time to time, we may use your personal information to send important notices, such as communications about changes to our terms, conditions, and policies. Because this information is important to your interaction with us, you may not opt out of receiving these communications while you continue to utilize the Platform. We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications.  

Personal Information Sharing

We do not sell or otherwise disclose personal information about you except as described here or disclosed at the time of collection.  We may share personal information with service providers we have retained to perform services on our behalf (such as data storage, customer support and data analytics). These service providers are contractually required to safeguard the information provided to them and are restricted from using or disclosing such information except as necessary to perform services on our behalf or to comply with legal requirements.

We may disclose personal information about you (1) if we are required or permitted to do so by applicable law or legal process (such as a court order or subpoena), (2) to law enforcement authorities or other government officials to comply with a legitimate legal request, (3) when we believe disclosure is necessary to prevent physical harm or financial loss, (4) to establish, exercise or defend our legal rights, (5) in connection with an investigation of suspected or actual fraud or illegal activity or (6) otherwise with your consent.

Security of your Personally Identifiable Information

To make sure your personal information is secure, we communicate our privacy and security guidelines to Whiz.ai employees and strictly enforce privacy safeguards within the company. We designed the Platform with a goal to secure your personal information, and the personal information of others on computer servers in a controlled, secure environment, designed to protect it from unauthorized access, use or disclosure. We intend to protect your information using technical, physical, and administrative security measures designed to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your information. Some of our safeguards include firewalls, data encryption, physical access controls, and administrative informational controls. While we have employed security technologies and procedures designed to assist the safeguarding of the information we collect from or about our users and their devices, no system or network can be guaranteed to be completely secure. No data transmission over the Internet can be guaranteed as 100% secure. As a result, while we strive to protect your information, we cannot ensure or warrant the security of any information you transmit to us or receive from us.

Communications with Whiz.ai

We appreciate your questions and comments about the Platform and Whiz.ai and welcome your messages to recipients listed on the Platform including messages or emails provided to our customer support. We will share your communications with those within our organization who are most capable of addressing the issues contained in your message. We may archive your message for a certain period or discard it, but your e-mail address and e-mail will only be used in accordance with this Policy.

Data Transfers

We may transfer the personal information we collect through the Platform to, and store such data in, other countries, including the U.S., which may have different data protection laws than the country in which the information was provided. If we do so, we will transfer the personal information only for the purposes described in this Privacy Policy. To the extent required by applicable law, when we transfer your personal information to recipients in other countries, we will take measures to protect that information.

Children’s Personal Information

The Platform is designed for a general audience and are not directed to children under the age of 13.  We do not knowingly collect, use or disclose personal information from children under the age of 13.  If we learn that we have collected the personal information of a child under the age of13, we will take steps to promptly delete the information.  If you believe that a child under the age of 13 may have provided us with personal information, please contact us at support@Whiz.ai.

Changes to this Policy

This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our information practices. We will indicate at the top of this Privacy Policy when it was most recently updated.

California Privacy Rights

During the preceding 12 months, we may have collected personal information and processed it pursuant to the California Consumer Privacy Act (CCPA) which provides certain rights.  The CCPA allows California residents to request that a business that collects California consumers’ personal information give consumers additional transparency and access to the specific pieces of personal information that the business has collected about the consumer.  California residents also have the right to submit a request for deletion of information under certain circumstances.

Consistent with California law, if you choose to exercise your rights, we will not charge you different prices or provide different quality of services unless those differences are related to your information.  Please submit your request by sending an email to support@Whiz.ai with "CCPA Request" in the subject line and in the body of your message and identify what your specific request is.  In addition, subject to certain limits under California law, California residents may ask us to provide them with (1) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (2) the identity of those third parties. To obtain this information, please send an email to support@Whiz.ai with "California Shine the Light Privacy Request" in the subject line and in the body of your message. 

Once we receive your request, we may verify it by requesting information sufficient to confirm your identity, including by asking you for additional information. If you would like to use an agent registered with the California Secretary of State to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. 

We will respond to such requests to information access within 30 days following receipt at the e-mail stated above. If we receive your request at a different e-mail or mailing address, we will respond within a reasonable period of time, but not to exceed 150 days from the date received. Please note that we are only required to respond to each customer once per calendar year.

GDPR Privacy Notice

This notice is for people who are located in the European Economic Area (“EEA”).  Our processing of personal data of people who are in the EEA is governed by the General Data Protection Regulation (the “GDPR”), which applies from May 25, 2018. The GDPR requires us to provide certain information to you about your personal data, which we refer to in this notice as your personal information.

Data Controller

For personal data that we collect and process about you, the data controller—as that term is defined in the EU General Data Protection Regulation (GDPR)—is Whizdotai, Inc.

Per your use of this Platform, we are not a data processor—as that term is defined in the GDPR.

Your European Legal Rights

If you are an EU or UK resident, you may have certain rights under applicable data protection laws in relation to your personal data, including the General Data Protection Regulation (GDPR) and the UK Data Protection Act of 2018 (DPA).  Subject to certain exceptions and limitations, these rights include:

  • The Right to Access: You have the right to request copies of your personal data we process about you.
  • The Right to Rectification: You have the right to request that we correct personal data about you that is inaccurate, and to complete information that is incomplete.
  • The Right to Erasure: You have the right to request that we erase your personal data if there is no further legal ground for processing such personal data.
  • The Right to Data Portability: Under certain conditions, you have the right to request that the data controller transfer your personal data to another organization or directly to you.

In addition, the GDPR requires data controllers to separately and explicitly highlight that you have the right to object to any processing based on a data controller’s legitimate interests (upon which we routinely rely upon as our legal basis) on grounds relating to your particular situation. However, the data controller may demonstrate either compelling legitimate grounds for the processing that override your interests or demonstrate that the processing is based on the establishment, exercise, or defense of a legal claim, in which case the processing may continue.

If you are resident in the EU, you have the right to file a complaint concerning our processing of your personal data with your national (or in some countries, regional) data protection authority.   The EU Commission has a list here:  http://ec.europa.eu/justice/article-29/structure/data-protection-authorities/index_en.htm.

Where our processing of your personal data is based on your consent for a specific purpose, you have the right to withdraw that consent. If you withdraw your consent, we will no longer process your personal data for that specific purpose unless we have another legitimate basis for processing under applicable laws.

If you exercise your applicable rights, we will not discriminate against you. Requests submitted pursuant to the GDPR will be addressed within 30 calendar days. If more time is needed to respond, we will notify you.

If you have any questions or concerns about Whiz.ai’s Privacy Policy, your personal information, data processing or if you would like to make a complaint about a possible breach of local privacy laws, please contact Whiz.ai at support@Whiz.ai. All such communications are examined and replies issued where appropriate as soon as possible. If you are unsatisfied with the reply received, you may refer your complaint to the relevant regulator in your jurisdiction. If you ask us, we will endeavor to provide you with information about relevant complaint avenues which may be applicable to your circumstances.
